Do I need a license to use video games in my cafe or bar?

Updated: Mar 3, 2021

If you are thinking of operating a business or you are already running a business that uses commercially developed games then you need to make sure you are operating legally.

In order to offer customers the ability to play video games (regardless of if they pay or not) then you have to purchase a commercial license for each game used. No ifs no buts!

What is a commercial license?

When you buy a physical game or download a digital game, you are invariably actually just “licensing” it. The license is a personal, noncommercial license subject to the ordinary EULA. You have probably already clicked accept and forgotten or chosen to ignore the contents.

A commercial license is different it is a license that allows you to use, in this scenario, a game in a public or commercial setting.

Regardless of if you’re running a venue or creating a venue and you don’t charge people for playing the games or if you’ve just got a bar with a few computers available, you must have a commercial licenses for any games. This applies to arcades, VR arcades, amusement/theme parks, university, exhibitions, stores and more.

Your game developers (that you depend on) can choose whether to offer a commercial license and what they will charge for the license. It is your role to ensure you receive the developer’s permission to offer a game in a commercial setting – a regular personal license to a game does not allow for commercial use.
